Responsibility

In case you are not familiar with using an expert, They can not as such represent you, their duty is to serve the court.

Even though they are likely to be instructed by, paid by one or more parties to the case, they must be impartial, present their evidence in an objective way.

Communication

The above does not mean you are restricted in supplying information, or contacting an expert witness, in most senses the opposite.

If expert evidence is to serve the court, no party should feel hindered in putting forward any detail they feel may help.

No Barriers

Those details do not need to follow technical dogma, or any party feel at a disadvantage due to lack of practical knowledge.

An expert should prefer to have the facts at their disposal. Asking for technical clarification is welcome and everyday language is fine.

Expert Evidence On Websites

As the web has grown, so has the need for expert evidence on websites. Any field can bring disputes, not least one quite new and not always understood. With our emphasis on a neutral, analytic stance, the role of expert witness in website related cases is logical, although we must fulfil that role well:

  • The expert assigned will have in depth knowledge of website development, the build process, value, search performance, user interaction.
  • They will be used to setting their views down in a manner suited to the court, preparing reports in an accepted expert witness format.
  • An understanding of their legal position, plus up to date knowledge of the Civil Procedure Rules, Practice Directions and Protocols are essential.
  • They will have experience of giving oral evidence, cross examination, handling written questions and meetings with other experts.

Above all, a good expert witness should ensure relevant facts and rational opinions are clear to all involved. If a case fails to be understood due to technical confusion, or poor communication, they have not done their job.

The Nature of Expert Reports

Expert witness reports on websites rarely avoid technical content but this must be explained, ideally so that someone who has never seen a website would understand the conclusions. Interpreting the web, alongside the relationship between developer and client is at the core of our services:
